1) Editorial

Red Light Debacle

For a couple of weeks I ran an item in the Morning Mirror, asking if anyone else had been unfairly fined for 'running' a red light when they were absolutely adamant they had done no such thing.

Well!!
The response!!

It would appear that it is a new initiative to get even more fine money out of the unsuspecting public. Even more pertinent now with the doubling of the fines. After all, it is 'your word against theirs'.

I don't know what to say, some of the horror stories that were sent to me made me blush with shame that our 'officers of the law' could behave like this.

One feels one should stand one's ground and do the horrendous 'court' route but this following story should deter one from going in that direction!

'A senior citizen friend (Rob, over 70 years old) was pulled over by the traffic police in S Parirenyatwa St after passing through the traffic lights at 14th Ave and accused of proceeding against an amber light.

He was adamant that he had not done so or, at worst, the lights had changed to amber as he crossed the line.

After much argument and getting nowhere, he therefore declined to pay an Admission of Guilt fine and elected to contest the matter in court.

He was duly summoned to the Magistrates Court but not all parties were present on the day so the case was postponed to a future date. This happened on 11 occasions (yes 11!) over a period of many months but on the 12th date the magistrate, prosecutor, police woman and accused were all finally present. The 'accused' was armed with extracts from the Highway Code indicating that it was permissible to proceed against an amber light if, when it changed to amber, it was not possible for the driver to stop safely due to his proximity to the white line, plus a chart, also from the Highway Code, with the accepted 'shortest stopping distances' for a vehicle at stipulated speeds.

The magistrate asked the police woman how far the car was from the line and she replied '5 metres'. Rob then happily produced the stopping distance chart which indicated that at 60km/h (the legal speed in town) that the shortest stopping distance is 36m (or 18m at 40km/h). This, he claimed, clearly demonstrated that he would have been unable to stop safely if the lights had changed to amber when he was 5m from the line.

The magistrate, however, declared that she found him guilty as she believed that he 'could have stopped if he had tried hard enough' and sentenced him to $20 fine or 20 days in jail. Rob obviously elected to pay the fine but when he wanted to proceed to the Fines Office to make payment, he was told it was lunchtime and the office was closed, and he was led away like a common criminal and detained in the cells at Tredgold Buildings. Whilst in the cells the warders constantly goaded him and attempted to obtain 'lunch money' from him, but he steadfastly refused. Finally after 2.00pm he was led back to the Fines Offices and paid he fine and was allowed to go free.

Although he was absolutely convinced of not being guilty of any wrong-doing, Rob claims that he just wishes now that he had paid the fine when first stopped although it would have been completely against his Christian principles to do so.

Every e mail I received was a similar tale of rabid injustice, and every person was treated with rudeness and disdain.

Why are we Zimbabweans so treated by the men and women who are employed to serve us and serve the true ends of justice in this country

On our travels we pass London Bobbys, Dallas Cops, Parisienne Gendarmes, Spanish Guardia and none of them have inspired anywhere near the fear and loathing with which our own police are received in this country.

I did google 'the ten most corrupt police forces in the world' and thank goodness we did not appear there however!

I was delighted to see in the Chronicle recently, that a number of police were arrested by the Donnington police for taking bribes. Maybe, maybe we are on the correct path to alleviating this sad sad situation in Zimbabwe.

I saw someone advertising 'dashboard cams' the other day, maybe this is the way to go!!

Now I don't mean to be the good citizen who takes up the cudgel for all things civic, like those amazing people who used to write to the newspapers in days gone by i.e. the esteemed Neil Dacomb and the erudite Martin Lee, but,
If anyone knows any senior cops, or the Minister of Law and Order, please forward this e mail to them!!

Bulawayo Help Network will be closed to the public from Friday 18th December 2015
to Tuesday 12th January 2015.

Our charity shop Treasure Pleasures last day of operation for this year will be Friday 18th December 2015. They will also be closing down for the festive season and will reopen on Wednesday 13th January 2016.

A busy week ahead for me and like-minded conservationists...I am contributing art for the Safari Golf Day on Friday at Borrowdale Brooke Golf Club- in aid of anti-poaching in the Save Valley Conservancy, and also I am the featured artist at the Art Escape Exhibition, ongoing at Victoria Falls Safari Lodge.....

Part proceeds from sales of my art at both events will benefit anti-poaching efforts-Victoria Falls Anti Poaching Unit (VFAPU) in the Falls and Save Valley Conservancy (SVC) anti-poaching fund in the SVC.
The urgency for thinking outside the box to save our rhinos and elephants from this huge poaching threat we face is pressing...
We WILL lose our rhinos in SVC very shortly if the killing carries on at present pace, and elephants country-wide are so diminished in numbers that we could be nearly too late to save the population of tusked bulls if we sit back and do nothing....
One option that I fully endorse is educating the general populace, the end users of the products from poached animals, about the reality and the sadness of where their products actually come from...so many rural users just do not know...

DOCTOR ZHIVAGO

Doctor Zhivago was released fifty years ago on 22 December 1965 and one of its stars, Omar Sharif, died in July of this year so it seemed a good opportunity to show this wonderful film again! It wasn't always so highly regarded but over time it has come to be seen as among David Lean's finest films as well as one of the best 'epics' ever made.
Beautiful cinematography and set design together with excellent performances combine to form Zhivago's timeless appeal. [Cinema Writer, 21 August 2006]

THE MERRY WIDOW AND PETER AND THE WOLF (BALLETS)
Friday 11 December in the Robert Sibson Hall at 6.30 p.m.
The first of two Merry Widows is an adaptation of Lehar's operetta for the Australian Ballet with choreography by Ronald Hynd which had its world premiere forty years ago in November 1975. This production is by the superb National Ballet of Canada with Australian dancer John Meehan as a guest giving an outstanding performance in the role of Count Danilo whilst the Merry Widow herself is beautifully portrayed by the Canadian prima ballerina Karen Kain. The ballet is quite short and will be preceded by the Royal Ballet's adaptation of Prokofiev's well-known musical tale Peter and the Wolf.

Wings over Jordan conducted by Misheck Ndlovu has been one of Bulawayo's top choirs for many years and they bring a traditional carol service to the Academy with well-loved carols and hymns for audience and choir together with guest appearances by soloists.

I just wanted to say a few words about my friend for over 55 years. Dudley was one of life's true gentlemen such a kind man and a more loyal friend one could not ask for. We shared so much together our days in Customs at Beitbridge the great times we had on Dodieburn, Kenilworth Estates, Henderson and sons, Matabeleland Tours and Safaris, Botswana Hunters, Tower Holdings. Wonderful memories and a friendship I will always cherish. R.I.P. my friend

OBITUARY
Roy G Stephens
12 April 1935 - 27 November 2015
Roy George Stephens was born in Bulawayo in 1935 and lived his entire life in the city, contributing to the sporting, cultural and business community of the City.
He attended Milton Junior School, and then went onto Milton Senior where he was head-boy in 1952. Many years later, he served as the Chairman of the School PTA, at a time when the school was transforming itself at Independence.
He went to the University of Cape Town, and subsequently joined the Bulawayo Board of Executors and Trust Company in 1958. He retired after 42 years' service in 2000 as both Chairman, a position he had held for many years, and a Managing Director.
During this period, and through the Bulawayo Board, he served as Chairman of Falcon Gold Mines Ltd (Falgold) having steered it to its listing on the Zimbabwe Stock Exchange. At the time Falgold was the country's largest gold producer. He was also Chairman of Olympus Gold Mines (Pvt) Ltd, Willsgrove Brick and Potteries (Pvt) Ltd, and a Director of Zimcor Ltd and Knight Frank and Rutley.
Roy was a Fellow of the Chartered Insurance Institute London, and served as Chairman of Willis Coroon, followed by Alexander Forbes from 2000 to 2010, Associated Brokers International (Pvt) Ltd and was the Chairman of WFDR Risk Services at the time of his death.
In the mining sector Roy was a well-known figure for many years, representing the Industry on two Government delegations to India and Canada shortly after Independence. He was elected President of the Chamber of Mines, having served for many years on the Executive and as Vice-President. He was also Chairman of the Mining Industry Pension Fund. Following his retirement in 2000 he was elected as a Life Member of the Chamber of Mines.
The Zimbabwe School of Mines was both established, and located in Bulawayo, during this period, almost entirely due to Roy's efforts and persuasion. The Zimbabwe School of Mining is now recognised as the SADC Centre of excellence for mining, a credit to the City of Bulawayo, but a tribute to a determined son of this City.
For many years he served as Chairman of CABS (Matabeleland Board) and was a member of the main Board. After his retirement he served as CEO of ABUZ, and was also Chairman of the Bulawayo Publicity Association, on which Executive he served for ten years.
On the sporting arena, Roy captained Matabeleland Hockey, and went on to play for his Country. He was a member of the first National Team to travel abroad.
As a boy he grew up very involved with Boy Scouts, with his crew winning the annual Assegai Competition, and earning the first ever Kings Scout Award in Southern Rhodesia. He went on to become a member of the Raylton Rover Crew, one of the last surviving member. It was from his scouting days that Roy became interested in botany, a lifetime hobby that was immensely rewarding and resulted in some significant work done in the Matobo Hills.
Roy's great passion was the Matobo Hills. Apart from his depth of knowledge and love of all that the hills have to offer, he was a member of the Rhodes Estate Matobo Committee, and served as Chairman of the Matobo Conservation Society.
Roy is survived by Joan, his children Sally, Gavin and Desmond, and four grandchildren.

The funeral service will be held at the City Presbyterian Church (J Moyo & 5th Ave) at 3.30pm on Wednesday 2nd December.

5) Roses And Raspberries
KGVI would like to say a big thank you to the Morning Mirror for all the help over the year. We also want to say thank you to those hard pressed people and companies in Bulawayo who have continued to find a way to support our work. It means so much to us to get local support. Special thanks to the hard working ladies and children from Whitestone who gave Christmas shoe boxes to ALL our children, all 340 of them. What a wonderful effort! With many thanks and best wishes to Bulawayo - may next year be considerably better for all of us!

Just to follow up on our notice to you all last week with regard to the SPCA fund raiser at Hornung Park on Friday 16th October 2015.

The evening was a great success and from all accounts the 160 people that passed through the doors thoroughly enjoyed themselves until the early hours!!

I read with interest the Obituary of Roy Stephens who was a great contributor to the Business and Sports Communities of Bulawayo and his knowledge of the Matopos and its flora and fauna was widely acknowledged but may I add a little to the history of the mining school in Bulawayo.
The original mining school was started by my father, P.H. Gifford in the early 1930's who brought Mr. Sydney Higham a geologist down from the Congo to head a mining department attached to the Bulawayo Technical School which my father started. I think this department was run from Heyman House which was in Clark Road between 5th & 6th streets; certainly the boys of the mining department had their boarding house there and Mr.& Mrs. Hingham their flat. In the early 1940's my father was given a gift of pound 10000 ( a huge sum in those days) by Mr. "V.C." Henderson a gold miner and rancher to build a dedicated mining school on the site in Park Rd. where the Technical College stands today. I well remember as a child seeing bricks delivered & stacked and my father pouring over architectural and technical drawings so thrilled about this development. Sadly the stacks of bricks stayed where they were and in due course the money was put towards the College which is there today. My father never forgave the Government of the day. He used to say " that money was given to me by a friend for a specific purpose." So, there's a little history of the mining school. I understand this is situated in Killarney and is, no doubt, the school Roy was so instrumental in getting going.

PROPOSED INCREASE OF DEPOSIT FINES:

Finance and Economic Development Minister Patrick Chinamasa announced in the National Budget for 2016 that Government will review traffic fines from 1 January, 2016. Minister Chinamasa said under the new fines,overtaking against white solid lines, driving through red robots, driving without a Drivers' Licence and not having a foot brake will attract $100 fines, up from $20.00, amongst other increases.

The Zimbabwe Republic Police (ZRP) apply a Schedule of Deposit Fines for a range of offences discovered during roadside checks. The maximum deposit fine a police officer can currently legally impose is $20.00 per offence. (A Level 3 fine). A fine higher than Level 3 can only be imposed by a magistrate after a court appearance.

In order for ZRP personnel to impose and accept payment of a $100.00 deposit fine - currently Level 4 - the law has to be amended, specifically the Criminal Procedures Act. Alternatively, all level fines have to be increased, which requires an amendment to the Finance Act (No. 3 of 2009). Whether its the Criminal Procedures Act or the Finance Act, these have to be amended during December, 2015, in order for the proposed new fines to be applied from 1 January, 2016.

The current Schedule of Deposit Fines is based largely on Statutory Instrument 154 of 2010, which was declared invalid and void in November 2012. We should therefore expect the Schedule to be updated to reflect the current Statutes, and the proposed new fines.

Therefore until such time as the law regarding level fines has been constitutionally amended , and a revised Schedule of Deposit Fines issued, the current Schedule and level of fines remains in effect.

New regulations for drivers crossing SA borders
The South African Police Service (SAPS) has implemented new regulations that require drivers of cars with South African-registered plates to carry certified documents proving ownership. This new requirement will be implemented at all South African border posts, according to Vishnu Naidoo, SAPS Head: Media Communications.

Drivers of South African-registered cars crossing SA borders must carry and present a certified copy of vehicle registration/vehicle licence papers at the border posts. This must be accompanied by a letter from the bank giving authorisation to take the vehicle across the border and must indicate dates of travel. Both the bank letter and licence papers should be signed by a Commissioner of Oaths.

If the driver of the vehicle is not the owner of the vehicle, an affidavit from the police giving authorisation from the financial institution/owner to take the vehicle abroad is required. If the car is rented, the driver must have a letter from the rental company giving permission to take the vehicle out of the country.

Regulations do change, and a customs officer advises SA travellers to check with the SA Auto Club on border regulation updates.

CITY OF LITTER

I drove into the heart of the 'City of Kings'. GREAT isn't it Or is it simply an UTTER disgrace This is just the sort of thing that we want to show visiting tourists/investors, that is if they can find the historical buildings in today's unwanted rubbish dumped in our public spaces. The bulk of it is fast food packaging which is band according to a EMA SI, or was that rescinded in the face of moneyed interests of the fast food chains But then again who really cares!

May be the City should be concerned, especially as there exist regulated fines for retailers who sell specified wrappings and other regulations aimed at people who drop litter - I think it is currently US5 PER ITEM and this goes up with the new budget. I am sure the BCC has additional regulations that also apply. But if the regulators don't bother enforcing the law, well why should people change their lazy, selfish attitudes Unfortunately I have lost an email with all our elected councillors' emails addresses for images such as these deserve to be circulated widely and I intend doing so. This is not my first complaint about the matter and I know others have also emailed on the same issue providing contrasting images from Mutare.

If the City cannot cope with this worsening crisis through nice appeals and putting out dustbins, well it is high time that the residents are actively encouraged - by stick if necessary. If the City and/or EMA starts fining people they will soon learn and the coffers will be improved to help pay for the clearing, the landfill, the blocked drains, etc. But the application of fines needs someone to man the streets and back, alleys fining the guilty which includes pedestrians, taxi operators and retailers.It is more than just the vendors which is the easy target to blame. This watching and fining must be across the city, day and night, at least as a serious blitz campaign for a while. This includes weekends.

You will know where these places are and the retailers nearby. Anti-Litter should be a campaign that the City enforces from the smallest piece, namely the cellphone recharge slip, to the container of rubbish tipped out the taxi near the Anglican Cathedral and by retailers into the servitude alleys. May be we need to have a nice smokey spectacle like a bomb-fire of burning plastic and other litter in the centre of town to get the message across.

These photographs don't do justice to the real magnitude of the problem but are snapshots of what left disgusted and embarrassed today. But, as I said above, who really cares!
